| Definitions "IMAGION " means IMAGION PROPRIETARY LIMITED "CYBERNAME " is a division of IMAGION PROPRIETARY LIMITED "We", "us" and "our" refer to CyberName. "SERVICE " means the URL (subdomain) redirection service provided by IMAGION PROPRIETARY LIMITED "USER " refers to all other persons, companies, or other entities identified on the attached service Sign up Form. "You" and "your" refer to each user. |
| 1. ACKNOWLEDGMENT AND ACCEPTANCE OF CYBERNAME TERMS OF SERVICE The CyberName Service ("Service"), owned and operated by Imagion Proprietary Limited ("Imagion"), is provided to you ("User") under all the terms and conditions of the CyberName Terms of Service and any operating rules or policies that may be published by Imagion or CyberName. This Sign up Form is submitted to curso motion design online ("CyberName"), for the purpose of applying for a subdomain and use of our redirection service. By completing the registration process, User agrees that he/she has read and agrees to be bound by all of the terms and conditions of the CyberName Terms of Service. |
| 2. DESCRIPTION OF SERVICE CyberName provides free URL redirection service, which allows User to redirect an easy-to-remember homepage address (subdomain) to his/her current homepage (Target URL). In the process of URL redirection, an advertising banner will display in return for using CyberName URL redirection service. Or you can pay us $23 USD per year to get rid of popup advertising window during redirection. However, any subdomain is violating our Terms of Service will be removed from our network and no refund will be given. |
| 3. USER ACCOUNT, PASSWORD AND SECURITY To register a subdomain, you must complete the sign up process by providing CyberName with current, complete and accurate information as prompted by the Sign up Form. You will choose a password and a subdomain. You will have to enter your current homepage address (Target URL). You are entirely responsible for maintaining the confidentiality of your password and subdomain. Furthermore, you are entirely responsible for any and all activities that occur under your subdomain and your target URL. You agree to notify CyberName immediately of any unauthorized use of your subdomain or any other breach of security. |
| 4. RULES User is solely responsible for the contents of his/her homepage it might redirect to. CyberName is not responsible for any content of any page it might redirect to or for any information entered by a User in its database. User may not create any subdomain to pages that contain illegal material, violate the Nettiquette. The contents of User's homepage (target URL) cannot contain, or contain links to, any of the following: copyrighted material not belonging to you, illegal software, illegal mpeg layer two or three files, child abuse, hate propaganda, gambling, sex, anything illegal, mail fraud, pyramid schemes, illegal share offer or insults to other persons or companies. User's right to use the Service is personal to User. User agrees not to resell of the Service, without the express consent of CyberName. CyberName reserves the right to delete any subdomain it deems unacceptable for any reason without prior notice. |
| 5. NO SPAM CyberName takes spamming activities very seriously and will immediately terminate the account without warning of any User who engages in them. CyberName will report such violations to the proper local, state and federal authorities, who may prosecute the case to the full extent of the law. |
| 6. RIGHT OF REFUSAL If User's homepage is always under construction, your subdomain will be removed from CyberName. Once you have registered your subdomain, you must get at least one visit of your subdomain within the first 10 days and then get at least one visit every 120 days there after to keep it activate. If any information provided by User is inaccurate, CyberName retains the right to terminate User's account and rights to use the service. CyberName, in its sole discretion, reserves the right to refuse to register or to delete the subdomain from any User for no reason. |
| 7. DISPUTE CyberName registers the subdomain on a "first come, first served" basis. The entity applying for a subdomain, User is solely responsible for selecting its own subdomain and maintaining for the continued accuracy of the registration record. User, by completing and submitting this Sign up Form, represents that the statements in its application are true and that the registration of the selected subdomain, to the best of User's knowledge, does not interfere with or infringe upon the rights of any third party. User also represents that the subdomain is not being registered for any unlawful purpose. User agrees that, if the registration of its subdomain is challenged by any third party, CyberName will may immediately cancel its subdomain and suspend his/her use of the CyberName's service. Imagion and CyberName shall not be liable for the dispute between User and the third party. |
| 8. PARTICIPATION IN PROMOTIONS OF ADVERTISERS Any dealings with Advertisers on the Service or participate in promotions, including the delivery of and the payment for goods and services, and any other terms, conditions, warranties or representations associated with such dealings or promotions, are solely between User and the Advertiser or other third party. CyberName and Imagion shall not responsible or liable for any part of any such dealings or promotions. |
| 9. MODIFICATIONS CyberName may change the CyberName Terms of Service or policies regarding the use of the Service from time to time. User agrees to review the CyberName Terms of Service periodically to be aware of such modifications and CyberName reserves the right to modify or discontinue the Service with or without notice to User. |
| 10. LIMITATION OF LIABILITY USER AGREES THAT CYBERNAME SHALL HAVE NO LIABILITY TO THE USER IF NETWORK SOLUTION INC HAS CANCELLED THE DOMAIN NAME FROM IMAGION PROPRIETARY LIMITED, IMAGION, MR ALEX NGAN OR MRS K S CHAN, CYBERNAME NEED TO CANCEL AND STOP THE SERVICE OF THE USER WITHOUT NOTICE. |
| 11. DISCLAIMER OF WARRANTIES USER AGREES AND UNDERSTANDS THAT CYBERNAME WILL NOT BE LIABLE FOR ANY DAMAGE CAUSED THROUGH THE USAGE OF CYBERNAME SERVICE. THE USE OF THE SERVICE IS DONE AT USER'S OWN RISK. CYBERNAME MAKES NO WARRANTY THAT THE SERVICE WILL MEET USER'S REQUIREMENTS, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, TIMELY OR ERROR FREE, NOR DOES CYBERNAME MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE OR AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SERVICE OR THAT DEFECTS IN THE SOFTWARE WILL BE CORRECTED. |
| 12. LAWS User agrees that this "CyberName Terms of Service" shall be governed by and construed in accordance with the laws of the Hong Kong SAR. User hereby agrees to submit to the exclusive jurisdiction of the Courts of the Hong Kong SAR. |
